Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the FitCheck AI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of any material changes through the App or via email. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

FitCheck AI is a mobile application that provides:

• AI Fit Checker: Upload photos of your outfits to receive AI-powered analysis and scoring
• Digital Wardrobe: Organize and manage your clothing items digitally
• Outfit Builder: Create and save outfit combinations from your wardrobe
• Wishlist: Save and track items you want to purchase

3. Account Registration

To use certain features of the App, you must create an account. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Your Content

You retain ownership of all photos, images, and content you upload to the App ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content for the purpose of providing our services.

4.2 Content Guidelines

You agree not to upload content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains explicit, offensive, or inappropriate material
• Contains malware, viruses, or harmful code
• Impersonates others or is fraudulent

4.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

5. AI Analysis Disclaimer

The AI-powered outfit analysis provided by FitCheck AI is for entertainment and informational purposes only. Please understand that:

• Fashion and style are subjective; our AI provides suggestions based on general style principles
• AI analysis may not always be accurate or appropriate for your specific needs
• Scores and feedback should not be taken as absolute measures of style quality
• We do not guarantee any specific outcomes from following our suggestions

You should use your own judgment when making fashion decisions.

6. Prohibited Activities

When using the App, you agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App or servers
• Use automated systems or bots to access the App
• Collect or harvest user data without authorization
• Use the App to distribute spam or malicious content
• Resell or redistribute the App or its features

7. Intellectual Property

The App, including its design, features, code, graphics, and all other elements (excluding User Content), is owned by FitCheck AI and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Pricing and Payments

FitCheck AI is currently free to use. If we introduce paid features or subscriptions in the future:

• Prices will be clearly displayed before purchase
• Payments will be processed through the App Store or Google Play
• Subscriptions may auto-renew unless cancelled before the renewal date
• Refunds are subject to the policies of the applicable app store

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION
• SECURITY FROM UNAUTHORIZED ACCESS

WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITCHECK AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL
• ANY DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless FitCheck AI and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

13. Termination

You may stop using the App at any time by uninstalling it and deleting your account.

We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms.

Upon termination, your right to use the App will immediately cease. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in San Francisco, California.

15. Dispute Resolution

Before filing a claim, you agree to attempt to resolve any dispute informally by contacting us at legal@fitcheckai.app. If we cannot resolve the dispute within 30 days, you may then proceed with formal dispute resolution.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitCheck AI regarding the App and supersede all prior agreements and understandings.
